Consequently, choosing someone trustworthy, organized, and capable is paramount. This individual needs to be able to navigate complex legal and financial matters with integrity and sensitivity.

I always encourage clients to select someone they trust implicitly, someone who understands their values and wishes. It’s also important to consider the individual’s age, health, and capacity to handle the responsibilities involved.

Moreover, it can be helpful to have a backup executor or trustee named in case the primary choice is unable or unwilling to serve.

Have you ever encountered any issues with clients choosing an executor or trustee?

Over the years, I’ve seen situations where clients haven’t given enough thought to this selection. Sometimes they choose a family member out of obligation rather than considering their suitability for the role.

I recall one instance where a client named their oldest child as executor, even though that child was struggling financially and lacked organizational skills. Unfortunately, it led to complications and disagreements among the beneficiaries after the client passed away.

Conversely, I’ve also seen cases where clients carefully considered their options and made excellent choices.

I once had a client who chose a close friend as trustee because they knew that individual was financially savvy and deeply trusted by the family. The result was a smooth and efficient administration of the estate, minimizing stress for everyone involved.

This underscores the importance of proper planning and making informed decisions about who will handle your affairs after you’re gone.
