I would say that “Marshaling the Estate Assets” is a pivotal stage. This involves meticulously inventorying all of the deceased person’s assets, including bank accounts, real estate, investments, and personal property.
Consequently, an accurate and comprehensive inventory is essential for determining the total value of the estate and ensuring that all assets are properly accounted for. Moreover, this step often involves obtaining appraisals for certain assets, such as real estate or artwork, to establish their fair market value.
- This information is then used to file an Inventory and Appraisal (Form DE-160/161) with the court.
- The accuracy of this document directly impacts subsequent stages of probate, such as calculating estate taxes and distributing assets to beneficiaries.
Notwithstanding the importance of this step, I have encountered instances where heirs or beneficiaries disputed the valuation of certain assets.
