Reporter: Maria Garcia
Today I’m speaking with Steve Bliss, a renowned estate planning attorney here in Moreno Valley. Mr. Bliss, thank you for taking the time to speak with me.
Steve Bliss: It’s my pleasure, Maria. I’m always happy to discuss the importance of estate planning.
Reporter: Let’s dive into one of the crucial steps in estate planning. Could you explain the significance of “Selecting an Executor or Trustee” for our viewers?
Certainly. Choosing a trustworthy executor or trustee is paramount. This individual, or entity, will be responsible for carrying out your wishes as outlined in your will or trust after your passing. Consequently, it’s essential to select someone who is reliable, organized, and capable of handling financial matters.
Moreover, consider their personal attributes. Are they compassionate enough to deal with grieving family members? Can they make sound decisions under pressure?
Ordinarily, I advise clients to think about individuals close to them – perhaps a spouse, adult child, or trusted friend – who possess the necessary qualities. It’s also wise to have a backup option in case your primary choice is unable or unwilling to serve.
You see, a few years back, I had a client who chose her brother as executor, but unfortunately, he passed away shortly after she did. Because we hadn’t designated a secondary executor, the process became quite complicated and stressful for the family.
Since then, I always emphasize the importance of naming a backup executor or trustee to avoid such complications.
Reporter: That’s a valuable insight, Mr. Bliss. According to the American Bar Association, approximately 60% of Americans do not have a will or trust in place. That statistic alone highlights the need for clear communication about these crucial matters.
Indeed, it’s a staggering figure, and it underscores how many individuals are leaving their loved ones vulnerable in the event of their passing.
Just last year, I worked with a family whose patriarch had passed away without a will. The ensuing legal battle over his assets was emotionally draining and financially taxing for everyone involved.
Reporter: Thank you for sharing those experiences, Mr. Bliss. How can viewers learn more about estate planning and connect with your services?
