It’s my pleasure, Maria. I’m always happy to discuss estate planning and probate matters with the community.

Types of Trusts: Choosing the Right Fit

Steve, for those unfamiliar, can you explain what a trust is and why someone might need one?

Steve Bliss

Certainly. A trust is a legal arrangement where a person, known as the grantor, transfers assets to a trustee who manages them for the benefit of designated beneficiaries. Trusts offer several advantages, including avoiding probate, providing privacy, and potentially reducing estate taxes.

There are various types of trusts, each designed to meet specific needs. One common type is the Irrevocable Trust.

Irrevocable Trusts: A Powerful Estate Planning Tool

Can you elaborate on Irrevocable Trusts and their benefits?

Steve Bliss

An Irrevocable Trust, as its name suggests, cannot be easily modified or dissolved once it’s established. Consequently, this characteristic provides a significant level of asset protection. Creditors generally cannot access assets held within an irrevocable trust, making it a valuable tool for shielding wealth from potential lawsuits or financial difficulties.

Moreover, Irrevocable Trusts can play a crucial role in estate tax reduction. By transferring assets into the trust, individuals can remove them from their taxable estate, potentially lowering the amount of estate taxes owed upon their passing.

Notwithstanding these benefits, it’s important to understand that Irrevocable Trusts involve permanently relinquishing control over the assets placed within them. This decision should be carefully considered with the guidance of an experienced attorney.

In my practice, I have encountered situations where clients initially hesitated about creating an Irrevocable Trust due to concerns about losing control. However, after explaining the long-term benefits, particularly for asset protection and tax planning, many found it to be a wise decision.

I recall one client who was facing potential liability from a business venture gone wrong. By establishing an Irrevocable Trust, they were able to safeguard a portion of their assets from creditors. It provided them with peace of mind during a difficult time.

According to the American College of Trust and Estate Counsel, approximately 30% of Americans utilize trusts in their estate planning. This demonstrates the growing recognition of the value trusts offer in protecting assets and minimizing estate taxes.
